Chapter 7 - The Duplex Eviction And The Pavement Inventory

On Lincoln Avenue, three miles north of the machine shop, a second storm was tearing Denise Mercer’s carefully constructed facade into pieces.
The duplex sat on a quiet, tree-lined street that Denise had spent years convincing her suburban social circle was an exclusive, high-end neighborhood.
Now, two white commercial moving vans sat idling at the curb, their exhaust fumes billowing into the freezing morning air.
Four burly men in heavy work gloves were methodically hauling pieces of antique furniture out through the wide double front doors of Denise’s home.
Denise stood on the frosted lawn in a silk dressing gown, her manicured fingers clawing at the arm of a female deputy who stood impassively on the walkway.
“You are violating my constitutional rights!” Denise shrieked, her voice screeching loud enough to bring three neighboring housewives onto their porches with recording smartphones in hand.
“I have lived in this duplex for six years!”
“I am a licensed boutique owner and a prominent member of the country club!”
“You cannot simply throw my personal effects onto the freezing asphalt like I’m a common criminal!”
The female deputy, Officer Martinez, did not budge an inch, her hand resting firmly on the heavy leather utility belt around her waist.
“Ma'am, step back behind the perimeter tape immediately,” Officer Martinez ordered with mechanical detachment.
“We are executing a court-certified emergency writ of restitution issued under Section 1923 of the Ohio Revised Code.”
“The property owner has produced verified documentation proving that your informal occupancy agreement was terminated following repeated material breaches of leasehold conduct.”
“The property owner has also presented evidence that you have accumulated over forty thousand dollars in delinquent rent payments over the past thirty-six months.”
“That is a lie!” Denise screamed, spit flying from her lips as she gestured wildly toward the moving crew.
“My brother Daniel owns this property!”
“Daniel gave me this house as part of our mother’s verbal inheritance!”
“He told me I could live here rent-free for as long as I needed to establish my business!”
At that moment, Nathan Hayes, the impeccably dressed representative from Vance & Associates, stepped down the concrete porch steps holding a glossy black folder.
“There was never any verbal inheritance agreement that supersedes a written master deed, Ms. Mercer,” Nathan said, his tone as smooth and cold as polished marble.
“Your brother Daniel purchased this entire parcel through an independent holding company called Buckeye Residential Ventures.”
“He allowed you to occupy the premises as an act of discretionary familial charity.”
“However, under the explicit terms of the Buckeye Residential lease charter, occupancy is contingent upon maintaining a zero-tolerance standard for illegal conduct and violent domestic endangerment.”
Nathan pulled a high-resolution photograph from his folder and held it directly before Denise’s wide, terrified eyes.
The photograph was a crystal-clear surveillance still taken from the CVS parking lot at 1:12 a.m.
It showed Emma Mercer huddled against the metal soda machine, her bare feet swollen and purple from the sub-freezing asphalt, holding her thin arms around her ribs.
“At 12:43 a.m., you actively participated in the forced, unlawful expulsion of a sixteen-year-old minor into life-threatening winter temperatures,” Nathan said, his voice ringing out clearly across the street for all the neighbors to hear.
“You aided in the illegal confiscation of her winter garments, her electronic school supplies, and her prescription asthma inhaler, which was found stuffed in the bottom of your son's laundry hamper forty minutes ago.”
“By order of the municipal housing court, your permissive occupancy has been revoked with prejudice.”
“Furthermore, Daniel Mercer has formally initiated civil forfeiture proceedings against your retail boutique downtown.”
Denise felt her knees go completely hollow, her body sagging against the cold bark of the maple tree behind her.
“What did you say about my boutique?” she gasped, her voice shrinking into a pathetic squeak.
“Your boutique, Denise’s Velvet Closet, operates inside a commercial strip center owned by Tri-State Retail Group,” Nathan replied without a shred of pity.
“Daniel Mercer is the primary institutional shareholder of Tri-State Retail Group.”
“He has instructed the commercial leasing director to terminate your retail lease effective at noon today due to eighteen consecutive months of unauthorized rent deferrals.”
“The locks on your downtown storefront are currently being changed by a private locksmith.”
“Every rack of designer clothing inside that store is being inventoried and impounded under a commercial landlord’s lien to satisfy the outstanding back rent you owe his holding firm.”
Behind them on the walkway, Cody came tumbling out the front door, wearing an unbuttoned designer shirt and clutching an armful of expensive shoe boxes.
Two moving workers stepped past him, carrying a massive 75-inch flat-screen television that had been mounted in Cody’s game room.
“Hey, put that down!” Cody yelled, his voice cracking with humiliation as he saw the neighborhood teens across the street filming him with their phones.
“That television was a Christmas present from Uncle Daniel two years ago!”
“It’s registered under Daniel Mercer’s corporate technology purchasing schedule, kid,” the lead mover grunted, not even pausing as he slid the massive screen into the back of the cargo truck.
“Corporate inventory stays with the corporation.”
“You want to keep your dirty socks and your gaming posters, you better grab them off the lawn before the sanitation truck arrives at noon.”
Denise collapsed onto her knees in the wet, frosted clover of the front yard, burying her face in her hands as the neighbors’ whispers drifted across the street like poison.

For six years, she had bragged at brunch tables and church gatherings about her effortless wealth, her brother’s infinite devotion, and her family’s untouchable social standing.
Now, her silk pajamas were soaked in mud, her private possessions were being piled like garage sale junk along the concrete sidewalk, and the golden brother she had exploited for a lifetime had just erased her from the map.
